1. Introduction

These Terms & Conditions govern all orders placed with Tom Hurley Ltd ("we", "us", "our") through our website at www.tom-hurley.com or any other means. By placing an order, you agree to these terms in full. Please read them carefully before proceeding. If you are purchasing as a business, for commercial trade, or for resale purposes, certain consumer statutory protections outlined in these terms (including statutory rights under the Consumer Contracts Regulations and Consumer Rights Act) may not apply, and our liability to you is limited to the value of the goods ordered.

2. Bespoke & Made-to-Order Products

All seats produced by Tom Hurley Ltd are handmade to order and custom-built to your individual specification. As such, they are exempt from standard consumer return rights under the Consumer Contracts Regulations 2013 (Regulation 28(1)(b)), which excludes goods made to the consumer's specification or clearly personalised.

This means: once your order is confirmed and production has begun, you do not have the right to cancel and receive a full refund solely because you have changed your mind. We strongly encourage you to review all design choices, measurements, and specifications carefully before confirming your order. If we have made an error that deviates from the agreed specification, we will work with you to resolve this at no additional cost. Your statutory rights in respect of faulty or misdescribed goods remain unaffected.

3. Deposits & Payment

3.1 A non-refundable deposit is required to secure your place in our order queue. The amount will be confirmed at the time of quoting.

3.2 The deposit is non-refundable as it covers design consultation, materials procurement, and queue allocation.

3.3 The remaining balance is due prior to dispatch. Work will not be dispatched until payment is received in full.

3.4 All prices are in GBP and inclusive of VAT where applicable.

3.5 Failure to pay the balance within 14 days of completion notice may result in cancellation and forfeiture of deposit.

4. Lead Times & Delays

4.1 Estimated lead times are provided in good faith and are not a guarantee of delivery by a specific date.

4.2 Lead times may be affected by material availability, supplier delays, or order complexity. We will communicate significant changes as soon as we are aware.

4.3 We are not liable for loss or additional costs from delays outside our reasonable control.

4.4 If you have a specific date requirement, please inform us at enquiry stage. We will advise whether it is achievable but cannot guarantee it.

5. Shipping & Damage in Transit

5.1 For consumer orders, risk of loss or damage to the goods passes to you only when the physical goods come into your possession (or the possession of a person identified by you to take delivery). For business-to-business or commercial trade orders, risk in the goods passes to you at the point of dispatch to the carrier.

5.2 We take great care to package all seats securely. However, because we are required to log transit claims with our couriers immediately, you must inspect your delivery upon receipt. In the event that your seat arrives damaged, you must: photograph the packaging and damage before use, report it to us within 48 hours with photographic evidence, and retain all original packaging.

5.3 Failure to report within 48 hours or retain packaging may affect our ability to claim on your behalf.

5.4 Shipping costs are non-refundable unless we are at fault.

5.5 For international orders, import duties and customs charges are your responsibility.

6. Intellectual Property

6.1 All photographs and images of finished work remain the intellectual property of Tom Hurley Ltd.

6.2 We reserve the right to use images of completed seats for marketing purposes unless you request otherwise in writing before your order is placed.

6.3 Nothing in these terms grants you a licence to reproduce, copy, or commercially exploit our designs.

7. Governing Law

These Terms & Conditions are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
